Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Elevate platform and related services (“Services”) provided by GuideAhead Services, LLC, a Georgia limited liability company, doing business as Volaire Studio (“Company,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility and Registration
- The Platform is available by invitation only to licensed real estate professionals in the United States.
- You must be at least 18 years old and hold a valid real estate license to use the Services.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You agree to provide accurate, current, and complete information during registration and to update it as necessary.
- We reserve the right to refuse, suspend, or terminate any account at our sole discretion.
2. Description of Services
Elevate is a software-as-a-service (SaaS) platform providing real estate professionals with:
- CRM — Contact management, deal pipeline tracking, activity logging, and lead scoring.
- Atelier — Custom agent website design, hosting, and management.
- Content — AI-assisted content creation including market reports, neighborhood guides, and blog posts.
- Intelligence — AI-powered contact insights, buyer matching, and farm monitoring.
- Insights — Website analytics, visitor tracking, and lead attribution.
- Analytics — Pipeline analysis, revenue tracking, and business metrics.
- Integrations — Data synchronization with third-party CRMs, email, calendar, and marketing tools.
- Nurture Sequences — Automated email campaigns and drip sequences.
3. Subscription and Payment
- Access to the Platform requires an active paid subscription, except during any free trial or beta period.
- Subscription fees are billed in advance on a monthly or annual basis as selected at enrollment.
- All fees are non-refundable except as required by law or as explicitly stated in these Terms.
- We reserve the right to change pricing with 30 days’ written notice. Price changes apply at your next billing cycle.
- Failure to pay may result in account suspension or termination.
4. Your Data and Content
4.1 Ownership
You retain ownership of all data you input, upload, or create through the Platform, including contact records, deal information, website content, and communications (“Your Content”).
4.2 License to Us
You grant us a limited, non-exclusive, worldwide license to use, process, store, and display Your Content solely to provide and improve the Services. This license terminates when you delete Your Content or close your account.
4.3 AI-Generated Content
Content generated by our AI features (contact briefs, lead scores, email drafts, blog posts, market reports) is created using your data as input. You own the AI-generated output. However:
- AI-generated content is provided “as-is” and should be reviewed before use.
- AI outputs are not legal, financial, tax, or professional advice.
- You are solely responsible for the accuracy and appropriateness of any AI-generated content you publish or send.
4.4 Data Portability
You may export Your Content at any time through the Platform’s export features. Upon account termination, we will provide reasonable assistance for data export during the 30-day retention period.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
- Violate the Fair Housing Act (42 U.S.C. § 3601 et seq.) or any state fair housing laws in your use of the Platform, including in communications, content, lead scoring, or automated sequences.
- Send unsolicited communications (spam) through the Platform’s email or SMS features.
- Upload or import data that you do not have the legal right to possess or use.
- Attempt to access other users’ accounts, data, or organizations.
- Reverse engineer, decompile, or attempt to extract the source code of the Platform.
- Use the Platform to store or transmit malicious code, viruses, or harmful data.
- Interfere with or disrupt the integrity or performance of the Services.
- Resell, sublicense, or provide access to the Platform to unauthorized third parties.
- Use AI features to generate discriminatory, misleading, or deceptive content.
6. Fair Housing Compliance
As a real estate professional, you have a legal obligation to comply with federal, state, and local fair housing laws. The Platform includes AI guardrails designed to prevent discriminatory outputs, but:
- You are ultimately responsible for ensuring all communications, content, and business practices comply with the Fair Housing Act.
- AI-generated content must be reviewed for compliance before publication or distribution.
- Lead scoring and contact categorization features are based on engagement behavior and transaction readiness, not on protected classes.
- We reserve the right to suspend accounts found to be using the Platform in a discriminatory manner.
7. MLS Data
- Property listing data displayed on agent websites and within the Platform is sourced from MLS providers through authorized data feeds.
- MLS data is subject to the terms and conditions of your MLS board membership.
- You are responsible for maintaining an active MLS membership with the boards whose data you access through the Platform.
- We cache MLS data for performance purposes in accordance with MLS board rules and do not claim ownership of MLS data.
- Display of MLS data on agent websites includes required MLS disclaimers and attribution.
8. Third-Party Integrations
- The Platform integrates with third-party services (CRMs, email providers, MLS feeds, etc.) that are governed by their own terms and privacy policies.
- By connecting a third-party service, you authorize us to access and process data from that service as described in our Privacy Policy.
- We are not responsible for the availability, accuracy, or security of third-party services.
- Integration credentials (API keys) are encrypted at rest using AES-256-GCM and are never exposed to other users or the client-side application.
9. Agent Websites (Atelier)
- Agent websites are custom-built and hosted by us on your behalf at a URL of your choosing (custom domain or platform subdomain).
- You are responsible for the content displayed on your agent website, including text, images, testimonials, and property data.
- Websites must comply with all applicable laws including ADA accessibility guidelines, fair housing regulations, and MLS display rules.
- We reserve the right to remove or modify website content that violates these Terms or applicable law.
- Custom domain setup requires you to configure DNS at your registrar. We assist with the technical setup but are not responsible for domain registration or renewal.
10. Intellectual Property
- The Platform, its design, code, features, documentation, and branding are the intellectual property of GuideAhead Services, LLC.
- “Volaire Studio,” “Elevate,” “ElevateAI,” and associated logos and marks are trademarks of GuideAhead Services, LLC.
- You may not use our trademarks without prior written permission, except as necessary to refer to our Services.
- Third-party product names, logos, and brands referenced in the Platform (integration providers, MLS boards, etc.) are property of their respective owners.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
- WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
- WE ARE NOT LIABLE FOR ACTIONS TAKEN BASED ON AI-GENERATED CONTENT, LEAD SCORES, OR RECOMMENDATIONS.
- WE ARE NOT LIABLE FOR DATA LOSS RESULTING FROM THIRD-PARTY INTEGRATION FAILURES, MLS DATA FEED INTERRUPTIONS, OR CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL.
12. Indemnification
You agree to indemnify and hold harmless GuideAhead Services, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from:
- Your use of the Services.
- Your violation of these Terms.
- Your violation of fair housing laws or other applicable regulations.
- Content you create, publish, or distribute through the Platform.
- Communications you send to contacts through the Platform’s nurture or messaging features.
13. Termination
- You may cancel your subscription at any time. Access continues through the end of your current billing period.
- We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with 30 days’ notice.
- Upon termination, your data is retained for 30 days, then permanently deleted. You may request data export during this period.
- Sections 10, 11, 12, 14, and 15 survive termination.
14. Dispute Resolution
- These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.
- Any dispute arising from these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
- Arbitration shall take place in the State of Georgia.
- You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
- Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
15. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Volaire Studio regarding the Services.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms. We may assign our rights in connection with a merger, acquisition, or sale of assets.
- Force Majeure: We are not liable for failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, government actions, or infrastructure failures.
- Notices: We may send notices to the email address associated with your account. You may send notices to us at the contact information below.
